I. RESOLUTIONS – MINISTRY OF MINES AND ENERGY (“MME”)

SubjectUpdate to the General Guidelines for the Oversight of Mining Titles
    Number40350
    DateJuly 29, 2026
DescriptionThe MME updates the general guidelines for conducting oversight of mining titles and other legal arrangements that, by law, permit mining exploration and exploitation, establishing operational, strategic, and administrative guidelines for the mining authority to carry out this function. Furthermore, the resolution elaborates on the concept of “differential oversight,” applicable to small-scale miners, beneficiaries of area reallocation for formalization, and recipients of mining formalization subcontracts, and establishes a maximum period of forty-five (45) calendar days for the issuance and notification of administrative decisions resulting from oversight visits.
TopicDelimitation of the Special Mining District for Productive Diversification in La Guajira
    Number40406
    DateAugust 12, 2026
DescriptionThe MME established the Special Mining District for Productive Diversification in La Guajira, which includes the municipalities of Albania, Barrancas, and Hatonuevo, without prejudice to the possibility that this designation may be extended to other neighboring municipalities.
SubjectDelimitation of the Special Mining District of the Cesar Life Corridor
    Number40407
    DateAugust 12, 2026
DescriptionThe MME established the Special Mining District for Productive Diversification known as the “Special District of the Cesar Life Corridor,” which comprises the municipalities of Agustín Codazzi, Becerril, Chiriguaná, El Paso, and La Jagua de Ibirico in the department of Cesar, without prejudice to the possibility that this designation may be extended to other neighboring municipalities.
SubjectAdoption of the Public Policy on Human Rights in the Mining and Energy Sector
    Number40408
    DateAugust 5, 2026
DescriptionThe MME adopted the Public Policy on Human Rights in the Mining and Energy Sector, applicable to both the MME and its affiliated entities, with the aim of progressively incorporating a human rights-based approach into its policies, plans, programs, projects, and management tools. According to the technical document, one of its objectives is to strengthen strategies aimed at the adoption of due diligence practices and responsible business conduct by actors in the mining and energy sector, among others.
TopicGuidelines for the Formulation, Adoption, and Implementation of the National Geoscientific Knowledge Plan
    Number40405
    DateAugust 5, 2026
DescriptionThe MME establishes guidelines for the formulation, adoption, and implementation of the 2026–2036 National Geoscientific Knowledge Plan, with the aim of guiding the generation, integration, administration, and use of the country’s geoscientific information for land and subsoil planning and use, water management, monitoring of geological hazards, and research on strategic minerals, among other purposes. The resolution assigns the Colombian Geological Service the task of coordinating the collection, analysis, and dissemination of geoscientific information and establishes a framework for coordination among the MME, the Colombian Geological Service, and the National Mining Agency.

    II. DRAFT RESOLUTIONS – MME

TopicAdoption of the Sectoral Framework for a Just Energy Transition (“TEJ”)
DescriptionThe draft resolution would adopt the TEJ Sectoral Framework as an instrument for public policy guidance, coordination, and technical monitoring, and would create the TEJ Technical Committee as a coordinating body, in which the National Mining Agency and the Colombian Geological Service would participate.  In the mining sector, the draft includes measures for the transition of the coal subsector, including the consolidation of Mining Districts for Productive Diversification, the allocation of funds associated with unconventional energy projects to promote economic diversification in coal-producing regions, and job retraining programs for workers in the sector. It also aims to establish actions to promote strategic minerals, formalize mining operations, and develop production chains geared toward reindustrialization and the energy transition.
SubjectRepeal of resolutions that defined the Special Mining Districts for Productive Diversification
DescriptionThe draft resolution would repeal fifteen (15) resolutions issued between 2024 and 2026, which established various Special Mining Districts in Antioquia, Nariño, Chocó, Huila, Valle del Cauca, Boyacá, Córdoba, La Guajira, the Pacific coast, Cauca, Cesar, and Norte de Santander.  According to the explanatory memorandum accompanying the draft resolution, the repeal is justified by the fact that the Special Mining Districts for Productive Diversification did not produce verifiable results, the Strategic Management Plans intended for their implementation were not formulated, and the mechanism, in its current form, is not the most suitable means of achieving the objectives set forth in Article 231 of Law 2294 of 2023.

III. DRAFT DECREE – MINISTRY OF COMMERCE, INDUSTRY, AND TOURISM

SubjectRepeal of decrees prohibiting the export of coal to Israel
DescriptionThe draft decree would repeal Decrees No. 1047 of 2024 and No. 0949 of 2025, which prohibited coal exports to Israel, and would reestablish the general regime applicable to exports of thermal coal, eliminating restrictions related to the destination country. This is without prejudice to compliance with applicable customs, foreign exchange, tax, environmental, origin, and control obligations, as well as prohibitions and restrictions arising from binding resolutions of the United Nations Security Council and international control regimes to which the Republic of Colombia is bound.

IV. DRAFT RESOLUTIONS – MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

SubjectRepeal of resolutions that designated the Food Production Protection Areas (“APPA”) in Cundinamarca
DescriptionThe Ministry of Agriculture and Rural Development published a draft resolution that would expressly repeal the resolutions establishing the APPA in the municipalities of Sopó, Nemocón, Cogua, Tenjo, and Tabio, in Cundinamarca. According to the published document, the draft resolution is based on a technical review that concluded that these areas lack sufficient technical justification to maintain their status as determinants of land-use planning.
TopicRepeal of resolutions that established and amended the APPA in the southern region of the department of La Guajira.
DescriptionThe draft resolution would expressly repeal Resolution 161 of 2024 and Resolution 289 of 2025, which designated and modified the APPA in the municipalities of Barrancas, Distracción, El Molino, Fonseca, Hatonuevo, La Jagua del Pilar, San Juan del Cesar, Urumita, and Villanueva, in the department of La Guajira, including the supporting technical documents, cartographic annexes, matrices, and other instruments that form an integral part of each of them.  According to the published document, the proposal is based on a technical review that concluded that these areas lack sufficient technical justification to maintain their status as determinants of land-use planning.

          V. PUBLIC POLICY DRAFT – NATIONAL COUNCIL FOR ECONOMIC AND SOCIAL POLICY

TopicNational Policy on Strategic and Critical Minerals 2026–2032
DescriptionThe draft CONPES document aims to adopt the National Policy on Strategic and Critical Minerals 2026–2032, which is designed to regulate the Colombian mining sector and promote the sustainable and sovereign use of these minerals. To this end, it proposes actions focused on geoscientific knowledge, land-use planning and governance, the generation of added value and production value chains, formalization and human development in mining activities, as well as traceability and security in the value chain.
