By means of court order of February 13^th of 2014, notified on February 21st of 2014, the Consejo de Estado (Council of State) decided with the purpose of unifying legal precedent, that the they are the competent entity in ruling, through a single instance, the legal actions taken against the Nation or entities of the same order regarding mining issues not related to contractual disputes. The aforementioned was decided in the course of an annulment and reestablishment of rights action initiated against the Ministry of Mines and Energy.
By means of Decision 2014011551, of February 24th of 2014, the National Mining Agency reiterated that majors are competent in determining the corresponding preventive measures or fines regarding illegal mining activities, those being, mining activities undertaken without holding a title registered in the National Mining Registry. Such measures would be executed through the National Police Department.
