  1. DRAFT RESOLUTIONS – MINISTRY OF MINES AND ENERGY (MME).
SubjectRequirements and procedures for the issuance of authorizations for the safe transport of radioactive materials in the Colombian territory.
DescriptionThe MME published a draft resolution that establishes the technical requirements and administrative procedures applicable to the issuance of authorizations for the safe transport of radioactive materials in the country.
The requirements are the following, among others, the technical description of the types of packages subject to authorization, the security evaluation, the radioactive material transport manual and the physical security plan during the transport of the material. As part of the authorization process, the authority will conduct an inspection to verify compliance with the safety and security requirements.
If the resolution is issued, the authorizations in force at the date of entry of the resolution shall remain valid for the term for which they were granted.
SubjectCreation of the National Mining Safety System – NMSS.
DescriptionThe MME published a draft decree that adds a section to the Sole Regulatory Decree of the Mines and Energy Sector, regarding the creation of the National Mining Safety System (NMSS) and its regulation. The purpose of this system would be to coordinate and articulate interinstitutionally the public entities of the national and territorial order, through strategies aimed at strengthening mining safety in the national territory.
The project seeks to create the National Mining Safety Commission, the Technical Committee and the Regional Mining Safety Commissions, coordination and follow-up bodies that will make up the NMSS.

DescriptionThe MME issued a resolution updating the guidelines to be implemented by the Colombian Geological Service for the exercise of knowledge and geological mapping activities of the Colombian subsoil in the royalty cycle.
Geoscientific information can be used as a technical tool for informed decision-making by communities, social organizations, sectors, and levels of government administration. In addition, it will generate knowledge on the potential of subsoil resources in line with the national Government’s priorities in mining-energy matters.

SubjectDetermination of damages arising from the exploitation of a third party who is not the titleholder of a mining title.

DescriptionThe Council of State issued a decision concerning a lawsuit filed by a mining titleholder against the Municipality of Rionegro. The high court analyzed whether the plaintiff had suffered damage derived from the municipality’s exploitation of construction materials in the area of his mining title.
The CE determined that, even though the plaintiff has a concession contract registered in the National Mining Registry, it does not have a consolidated right to exploit considering that, among others, it does not have the environmental license to carry out the operation. Likewise, he alludes to the fact that he does not have property rights over the land where the exploitation is carried out.
