The Superintendence of Companies, by means of the Concept 220-084517 of May 20th, 2020, has once again stated that promotion and/or commercialization activities carried out in multilevel networks may be performed by third parties that do not produce the goods or render the services, provided that, in accordance with Law 1700 of 2013 and Decree 24 of 2016: (i) a commercial representation agreement exists between the third party and the entrepreneur, by which the third party is enabled to promote and/or commercialize the goods and/or services of the entrepreneur in a multilevel system; and, (ii) the third party that acts as a commercial representative of the entrepreneur is incorporated as a company under Colombian law.
