Summary: A group of Patents has been granted in Venezuela after 15 years of absence of these Resolutions given the economic and Political situation of this country.
Through Bulletin No. 608 of Intellectual Property, Resolutions No. 572 and 577 of May 5, 2021 were issued by the Venezuelan Patent Office in which a group of five Patents were granted. Within this mentioned group, one Patent is for a national Patent Holder and the remaining four Patents are for foreign Patent Holders, which comprise Patents from different technology fields as Engineering and Pharmaceutical.
It is important to highlight that these patents have been granted without any special condition or limitation further than the normal time limit of enforcement, which is 20 years since the filing date. As well, no appeals nor oppositions were filed against these resolutions.
Given the political and economical situation in Venezuela, Patents of Invention were not granted for about 15 years and specifically, Patents (Invention nor Utility Models) of foreign Applicants were not granted since 2008.
In accordance, this situation represents a very optimistic and positive news for what the pending patent applications may expect.
