Report 75: Integration of report 50 and report 52

REPORT 75: INTEGRATION OF REPORT 50 AND REPORT 52

The Superintendency of Companies issued External Circular No. 100-000003, which introduces significant changes in reporting requirements for companies classified as Obliged Subjects under the implementation of the Self-Control System and Comprehensive Risk Management for Money Laundering, Terrorism Financing, and Financing of Weapons of Mass Destruction Proliferation (“SAGRILAFT”), the Minimum Measures Regime of SAGRILAFT, and the Corporate Transparency and Ethics Program (“PTEE”), as per Chapters X and XIII of the Basic Legal Circular.

One of the most notable updates is the integration of Report 50 and Report 52 into the new Report 75. This measure aims to streamline processes and enhance the submission of relevant information.

If your company is categorized as an Obliged Subject for SAGRILAFT and/or PTEE, it’s crucial to take note of the following deadlines for submitting Report 75, as of December 31, 2022:

For future reporting periods and years, the following deadlines should be observed, based on the last two (2) digits of the NIT of the Obliged Subject:

The circular also specified deadlines and requirements for Report 42 – Business Practices, which must be submitted annually by companies under the supervision and control of the Superintendency of Companies. Please adhere to the following deadlines:

Finally, in the same circular, the Superintendency of Companies referred to the submission of Report 58 – Compliance Officers, stating that this report, along with additional documents, must be submitted by Obliged Subjects who have a SAGRILAFT and/or PTEE Compliance Officer, in accordance with the Basic Legal Circular, within fifteen (15) business days following their appointment or change by the competent body.
